What starts with a small pair of shoes outside the front door quickly escalates: heavy wooden cabinets, bicycle racks, baby strollers, and thirty decorative flower pots colonize the common hallway. In an emergency fire evacuation, these obstacles cost lives.
Why Corridor Encroachments Violate Fire Laws
Under the National Building Code (NBC) of India, common floor corridors and stairways are designated as primary Means of Egress (escape corridors). The law mandates a minimum clear, unobstructed width (typically 1.5 to 1.8 meters) at all times.
Wooden shoe racks and dry plastic plants are combustible fuel sources. During a dark, smoke-filled fire evacuation, a fallen shoe rack or bicycle can trip escaping residents and block firefighters carrying heavy pressurized hoses.
The Legal Notice and Removal Process
An RWA cannot simply confiscate personal property without due process:
- Step 1: Issue a general advisory citing specific fire safety regulations and municipal bylaws.
- Step 2: Issue an individual 7-day written notice to the defaulting flat owner requesting voluntary removal.
- Step 3: If unheeded, the committee has the legal authority to remove the obstruction from common property, shifting it to a basement storage holding area at the owner's expense.
Common questions
Does an owner own the corridor space directly in front of their entrance door?
No. The private boundary ends exactly at the outer face of the apartment door. All hallway spaces, lift lobbies, and passages are undivided common property.
