The Animal Welfare Board of India, backed by multiple High Court and Supreme Court rulings, has laid down unambiguous statutory guidelines regarding pets in multi-story apartments.

- Breed or size bans: Societies cannot restrict dogs based on size, weight, or breed.
- Barking complaints: Barking is a natural dog behavior; occasional barking cannot be classified as an illegal nuisance without documented harassment evidence.
- Lift usage: RWAs cannot ban dogs from passenger elevators or levy special pet surcharges for lift maintenance.
Reasonable Regulations RWAs Can Legally Enforce
While bans are invalid, RWAs have full authority to implement sensible safety and hygiene protocols for common property:
Pet parents must keep dogs leashed at all times in lobbies, gardens, and corridors. Pet owners must immediately clean up after their pets if an accident occurs in common elevators or walkways.
- Mandate up-to-date anti-rabies vaccination records filed with the society office.
- Designate specific pet defecation relief zones with disposal bins away from children's play areas.
- Encourage training and behavioral counseling for dogs showing aggressive reactivity to delivery workers.
Common questions
Can an RWA force pet owners to use only service lifts?
No. If a society has only one lift or the service lift is non-functional, pets cannot be denied access to regular elevators.
Can a landlord terminate a rent agreement because of an RWA pet ban?
No. Since the RWA pet ban itself has no legal standing, courts do not recognize pet ownership as valid grounds for lease violation unless explicitly written into a bilateral agreement.
