Taking over a newly constructed society from a real estate builder is the highest-stakes milestone in a community’s lifecycle. Once the handover protocol is signed, the developer walks away, leaving the RWA to pay for incomplete wiring, leaking basements, and missing permits.

Statutory RERA Handover Mandates

Under Section 17 of the Real Estate (Regulation and Development) Act (RERA) 2016, the promoter must execute a registered conveyance deed transferring the common property and land title to the association of allottees within three months of receiving the Occupancy Certificate (OC).

Section 14(3) further mandates a 5-Year Structural Defect Liability Period: the promoter is legally required to rectify any structural defect or workmanship flaw within 30 days at zero cost to the residents.

The Complete Technical Document Checklist

Do not sign the handover receipt until every one of these documents is verified by a professional auditor and structural engineer:

  • Sanctioned Building Plans & As-Built MEP Drawings (Plumbing, Electrical, Drainage layouts).
  • Occupancy Certificate (OC) & Completion Certificate (CC) from the local municipal corporation.
  • Permanent Fire Safety NOC and hydrants pressure test certificates.
  • Lift Inspector licenses and manufacturer warranty documents for all elevators.
  • Diesel Generator (DG) set pollution clearances (CPCB) and electrical inspector approval.
  • Sewage Treatment Plant (STP) design capacity manual and State Pollution Control Board discharge consents.

Financial Audit & Corpus Fund Handover

The builder must transfer the full unspent interest-free maintenance security (IFMS) or corpus fund collected from all buyers into the society’s official bank account along with audited accounts.

Property tax assessment ledgers must be reconciled so previous builder dues do not penalize new apartment owners.

Common questions

What if the builder refuses to hand over the corpus fund?

The RWA can file an execution petition before the state Real Estate Regulatory Authority (RERA) under Section 17, which can freeze promoter bank accounts.
