A housing society election is the democratic foundation of community living. Yet, poorly conducted polls frequently collapse into allegations of rigged ballot boxes, forged voter registers, and unending litigation. Here is how clean elections are conducted under cooperative election rules.

Appointment of Independent Returning Officer

The outgoing managing committee cannot conduct its own election. Under state election authority guidelines, the society must appoint an independent Returning Officer (RO) or request the Cooperative Election Authority to depute an official election officer.

The RO takes over the election machinery, publishes the preliminary voter roll, invites nominations, scrutinizes eligibility, and declares the final ballot.

Who Is Eligible to Contest?

To contest a managing committee seat, an individual must be a confirmed primary share-owner of a flat. Associate members can contest only if the primary owner gives written consent and forfeits their own right to contest.

Members who have unpaid maintenance dues exceeding three months, individuals with criminal convictions, or persons who have sublet their entire flat without notifying the society are disqualified from contesting.

  • Term of office: Typically 5 years under most state cooperative amendments.
  • Mandatory quotas: Many states mandate reservations for women members (usually 2 seats).
  • Resignation of committee: If more than 50% of committee members resign, the entire committee is deemed dissolved, and an administrator is appointed.

Can a tenant contest an RWA election?

No. Only registered property owners or authorized legal associate members holding share certificates can contest managing committee elections.
