CCTV cameras deter parcel thefts, vandalized vehicles, and unverified gate entries. But when a committee points a camera directly at a resident's front door or when private footage ends up leaked on a community group, the society enters serious legal jeopardy.
Permissible vs Prohibited Camera Locations
Under Indian privacy law (Article 21 and the DPDP Act 2023), surveillance must balance community safety against an individual's reasonable expectation of privacy:
- Permissible Common Zones: Main entry barriers, perimeter boundaries, basement driveways, lift lobbies, elevator interiors, and electrical transformer enclosures.
- Prohibited Zones: Inside clubhouse swimming pool changing rooms, restrooms, gym areas, or any angle pointing into private apartment interiors.
- The Corridor Dilemma: Cameras installed in floor corridors must be angled strictly down the hallway toward lift doors or fire escapes — they cannot be aimed directly into an open apartment doorway.
Footage Access Control & Data Retention
Network Video Recorders (NVRs) must be locked in a secure server rack inside an access-controlled room. Casual viewing by unauthorized committee members or guards is a gross violation of privacy.
Establish an official written Footage Request Policy: CCTV footage should only be extracted for verified security incidents, insurance claims, or upon written request by law enforcement authorities. Standard retention periods should be set between 30 to 45 days.
Common questions
Can an individual resident install a private camera outside their apartment door?
A resident can install a video doorbell or small camera outside their door provided it does not capture the private interior of their neighbor's opposite apartment.
